Abstract

In the article, how human rights are applied in Turkey and in the world in the historical process and the positive and negative aspects of them in the places where they are applied are mentioned. In addition, it has been observed that human rights, which are not based on democracy and justice, create disruptions in general and decisions are made according to the individual. It has been mentioned that human rights are not fully understood in the world in general, and therefore cannot be fully implemented. It has been stated that the courts often do not make appropriate decisions, they make decisions according to the individual, and this creates injustice among people. It was touched that humanity should be based on all rights and that everything else should be human-oriented. It has been stated that people in our country sometimes do not get their rights in local courts and they apply to the Constitutional and sometimes European Human Rights Courts, which are higher courts, to obtain these rights, and that the majority of the applicants won their cases. It has been observed that this situation negatively affects the prestige of our country. It was stated that our citizens who are justified in their cases should get their rights in the local courts in their own countries and that our internal problem should not be turned into an external one. It was stated that the reason for this was due to the lack of competence of some judges and prosecutors at the head of the courts. It was stated that the development of human rights did not follow the same process all over the world, and that natural rights were given to people depending on the development of the country. It was expressed that the state has duties and responsibilities towards individuals, just as the individual has duties towards the state. While this study was being carried out, it was tried to give extensive information about the subject by scanning both the internet and written sources.
